UPDATE: In a news conference on Thursday, Feb. 22, New York State Police say that a man in Steuben County assaulted his sister with a frying pan on Tuesday that later resulted in her death.
According to Captain Kevin P. Sucher, 60-year-old Heather L. Moran died from her injuries on Wednesday, Feb. 21, at around 1 p.m. at Robert Packer Hospital in Sayre, PA.
Sucher said that her brother, John N. Marvin II attacked Moran with a cast iron frying pan on Tuesday, Feb. 20, inside of a trailer home on Victory Highway in the town of Erwin.
Sucher said that Moran did not live at the trailer and that she went to the home on Tuesday, around 3:45 p.m., to help Marvin in aiding their 81-year-old father.
Police said that when Moran and her father were sitting at the kitchen table, Marvin struck Moran in the head with the pan several times. The father attempted to intervene, standing up from his wheelchair, but lost his balance and fell to the ground, unable to move. Sucher added that the father wasn’t injured and was taken to the hospital following the incident.
Sucher said that Marvin called 911 following the assault and waited outside for police to arrive before he was arrested without incident. Police added that Marvin did not have a criminal history.
Police say that Marvin was initially charged with attempted murder in the second degree and assault in the first degree. Following the death of Moran on Wednesday, Marvin’s attempted murder charge changed to murder in the second degree. In New York State, murder in the second degree carries a sentence of 25 years to life in prison.
Marvin is currently at the Steuben County Jail and is being held without bail.
PAINTED POST, N.Y. (WETM) — New York State Police out of Painted Post is expected to hold a news conference on Thursday to provide more information into the killing of a 60-year-old woman who died of her injuries as a result of an assault on Tuesday, Feb. 20.
As of Wednesday, Feb. 21, police say that 59-year-old John N. Marvin II has been charged with second-degree murder, a class A-1 felony, after an assault that left one victim critically injured before later dying at the hospital.
Police say that the assault took place around 5 p.m. on Tuesday inside a home on Victory Highway in Erwin.
